1. Acceptance of Terms
By accessing or using ki2use.com (the "Site"), placing an order, or otherwise interacting with KI2USE ("we," "us," "our"), you agree to be bound by these Terms of Service ("Terms") and all policies incorporated herein, including our Privacy Policy, Shipping Policy, and Return & Refund Policy. If you do not agree to these Terms, please do not use the Site. These Terms constitute a legally binding agreement between you and Dkmd LLC, the company that operates KI2USE. By continuing to use the Site after any modifications to these Terms, you accept and agree to the revised Terms.
2. Eligibility
You must be at least 18 years of age to make purchases on this Site. If you are between 13 and 17 years old, you may browse the Site only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf. By using the Site, you represent that you meet the applicable age requirements and that all information you provide is accurate and complete.
3. Products and Pricing
All product descriptions, images, and specifications on the Site are provided in good faith. We reserve the right to correct errors in pricing or product descriptions and to cancel orders affected by such errors, even after an order has been confirmed. Product colors may vary slightly due to monitor calibration. Prices are listed in U.S. dollars (USD). Sales tax may be applied where required by law. We make every effort to display accurate inventory information, but we cannot guarantee that items will be in stock at the time of purchase. If an item becomes unavailable after your order is placed, we will notify you and issue a full refund.
4. Orders and Payment
When you place an order, you are making an offer to purchase the selected product(s) at the listed price. Your order is not confirmed until you receive an order confirmation email. We reserve the right to refuse or cancel any order for any reason, including product availability, pricing errors, or suspected fraud. Payment is processed securely through PayPal. We accept PayPal balance, Visa, Mastercard, American Express, Discover, and PayPal Credit. All transactions are encrypted using 256-bit SSL technology. We do not store your full card number on our servers. Orders are processed on business days (Monday through Friday, excluding federal holidays). Orders placed after 2:00 PM PST may be processed the following business day.
5. Shipping and Delivery
We ship to all 50 U.S. states, including Alaska and Hawaii. Standard shipping is $6.99 and takes 5–7 business days. Express shipping is $12.99 (2–3 business days). Overnight shipping is $24.99 (next business day). Free standard shipping on all orders totaling $75 or more after discounts. Delivery timeframes are estimates and are not guaranteed. We are not responsible for delays caused by carriers, weather, or other circumstances beyond our control. Risk of loss and title for items pass to you upon delivery to the carrier.
6. Returns and Refunds
We accept returns within 30 days of the delivery date. Items must be unworn, unwashed, unaltered, and in their original packaging with all tags attached. To initiate a return, email contact@ki2use.com with your order number. Refunds are processed within 5–10 business days to your original payment method. Original shipping costs are non-refundable unless the return is due to our error.
7. Intellectual Property
All content on the Site — including text, graphics, logos, product images, and software — is the property of Dkmd LLC or its content suppliers and is protected by U.S. and international copyright, trademark, and intellectual property laws. You may not reproduce, distribute, or exploit any content from the Site without our express written permission.
8. User Conduct
You agree not to use the Site for any unlawful purpose or in any way that could harm, disable, or impair the Site. Prohibited activities include scraping, submitting false information, impersonating others, uploading malicious code, and attempting unauthorized access to any portion of the Site.
9. Disclaimer of Warranties
The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. We do not warrant that the Site will be uninterrupted or error-free.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Dkmd LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or products purchased thereon. Our total liability for any claim shall not exceed the amount you paid for the product(s) at issue.
11. Indemnification
You agree to indemnify, defend, and hold harmless Dkmd LLC and its affiliates, officers, directors, employees, and agents from and against any claims, damages, obligations, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Site or violation of these Terms.
12. Governing Law
These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved in the state or federal courts located in Los Angeles County, California.
13. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in full force. These Terms, together with our Privacy Policy, Shipping Policy, and Return Policy, constitute the entire agreement between you and KI2USE regarding your use of the Site.
